Wife: Cop shouldn’t have had his firearm

SOUTH PHILADELPHIA. The estranged wife of the cop charged with killing his brother-in-law Sunday said she filed a protection from abuse order against him last year, which should have prompted officials to take Rudolph Gary’s service weapon — but Internal Affairs said it never got the notice.

Chief Inspector Anthony DiLacqua said the notices are usually passed down from the officer’s supervisor, but there is no record of the order against Gary — filed just days after he allegedly drew his gun on Shanae Williams and her brother, Howard Williams, following a domestic dispute in October.

“I show no record of her filing for a PFA,” DiLacqua said. “Of course, I never say anything’s 100 percent.”

If that order had been received, DiLacqua said, Gary would have been placed on administrative duty and his service weapon would have been taken.

Gary, 26, was charged with murder after shooting 22-year-old Howard Wil-liams. According to eyewitnesses, Gary’s girlfriend got into a fight with another young woman and he retrieved his gun before shooting Williams in cold blood. He has been suspended with the intent to dismiss.

Shanae Williams took little consolation in Gary’s firing, noting “it’s a little late.”

“He should’ve been fired,” she said. “I know people make mistakes, but this one cost my brother his life.”
